SIMPLY DRESSES TERMS AND CONDITIONS

** Once your order is placed, you cannot change, alter, or cancel your order in any way. In the event an item in your order is not available you will be offered alternatives or the option to receive a full refund for the item to the original payment method. **

** If for any reason you are not completely satisfied with your purchase you may return your merchandise for store credit less applicable fees. Final Sales items cannot be returned or exchanged. Shipping fees are non-refundable.

** Special Occasion dresses are delicate and require extra caution when handling. Our items are carefully inspected before they are shipped to you. If for any reason you receive an item that is less than perfect, you must let us know within 48 hours of receipt of the package.

** All items should be returned in the same condition as when you received them. Items returned without tags, appear to have been worn, washed, altered, stained, have an odor, have pet hair or appear to have been tampered with in any way, may be subject to the return being rejected and the item returned to the customer at their expense.

** We have no control and accept no responsibility for the sizing you select for your merchandise. Please check the provided size chart to ensure correct sizing. **

RETURN AND EXCHANGE POLICY

RETURN INSTRUCTIONS
-A RA# must be requested within 5 days of receipt of the item and the package shipped to us no more than 10 days after the RA has been issued. Packages without a RA # or outside 5 days will be denied and/or refused.

-Place your item back in the bag or box with your original packing slip. Clearly write your return authorization number on the outside of the return package.

-Once your item is received and inspected, we’ll send you an email notification that your refund has been processed to the original payment method. Shipping fees are non-refundable.

-All returns are charged a handling fee per item. The handling fee for the first item is $8.95 and additional items in the same box is $2.95 per item. A prepaid shipping label* is included in this fee and can be requested at time of return authorization request. You may also use your own label using any other trackable method.

-*Continental US only. All international customers are responsible to pay any and all fees when shipping back an item. (Duties, taxes, brokerage fees, etc.)

Once we receive your package, it can take up to thirty business days to process your store credit. If you need an exchange that is time sensitive due to an upcoming event, please let us know ASAP and we will work with you to expedite the process! Final Sale items cannot be returned or exchanged.

REFUNDS AND SHIPPING

INTERNATIONAL SHIPPING
You may be subject to import duties and taxes, which are levied once a shipment reaches your country. Additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Custom and import duties are not included in our shipping charges.

Customs policies vary widely from country to country; you should contact your local customs office for further information before you place your order. Additionally, when ordering from Simplydresses.com you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.

 

Simplydresses.com reserves the right to approve which countries it will ship to and in the event a country is not approved, the buyer will receive a full refund.

On international shipments, delays may occur that are beyond our control caused by such factors as weather, language barriers, duties, taxes, import restrictions and custom services.

If duties are not paid upon entry to the destination country, or the merchandise is refused, the product will be abandoned in the destination country and the customer will be responsible for 100% of the product cost and shipping. The customer will not receive any type of refund or credit for abandoned products.

ORDER CHANGES AND CANCELLATIONS

PRODUCT AVAILABILITY

Simplydresses.com has made every effort to display accurately the products featured on the Site. However, the colors we use and the capabilities of your computer monitor will affect the colors you see on your screen. Simply Dresses cannot guarantee that your computer monitor will accurately display color, texture, or any merchandise details.

Simply Dresses is not responsible for errors made in selecting a dress size and cannot guarantee a dress will fit. It is the sole responsibility of the shopper to use a tape measure to take their measurements properly and then select the size that best fits them based on the size chart for the particular item purchased. Simply Dresses reserves the right to change sizes available and the size charts at any time.

SITE CHANGES

In order to keep the site current with our latest fashion ideas, Simply Dresses frequently changes the merchandise offered. This means that we cannot guarantee that an item displayed on a previous visit to the Site will still be available when you visit again. We reserve the right to make changes to the Site without prior notice. Should you be unable to locate an item you saw on a previous visit, please contact us and we will make every effort to meet your needs. Prices displayed on the Site are quoted in U.S. dollars and are valid and effective only in the United States.

Risk of Loss: Risk of loss or transfer of title to the Buyer or customer occurs when Simply Dresses delivers the merchandise ordered to a common carrier in good condition for shipment to the customer.

User Comments, Feedback, Postcards, and other submissions: We welcome your comments and feedback regarding the Site, our products and our services. All comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to Simply Dresses on or by the Site or otherwise disclosed, submitted or offered in connection with your use of the Site (collectively, the "Comments") shall be and remain Simply Dresses' property.

Such disclosure, submission or offer of any Comments shall constitute an assignment to Simply Dresses of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments without payment of any compensation.

Thus, Simply Dresses will own exclusively all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise, of any Comments. California Consumer Privacy Act

This section provides additional details about the personal information we collect about California consumers and the rights afforded to them under the California Consumer Privacy Act or “CCPA.” The words used in this section have the meanings given to them in the CCPA, which may be broader than their common meaning.

We collect this information for the business and commercial purposes described in the “Why And How Do We Use Your Personal Data?” section above. We share this information with the categories of third parties described in the “Sharing Of Your Personal Data” section above. We do not sell the personal information we collect and will not sell it without providing a right to opt out. Please note that we do use third-party cookies for our advertising purposes as further described in the “Cookies And Pixel Tags” section above.

Subject to certain limitations, the CCPA provides California consumers the right to request (a) more information about the categories and specific pieces of personal information we have collected and how we use and disclose this information, (b) deletion of their personal information, and (c) to opt out of any “sales” that may be occurring. We will not discriminate against you if you exercise your rights under the CCPA.

California Online Privacy Protection Act (“CalOPPA”)

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law's reach stretches well beyond California to require any person or company in the United States (and conceivably the world) that operates websites collecting personal information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals or companies with whom it is being shared.

According to CalOPPA, we agree to the following:

  • Users can visit our site anonymously.
  • We will include a link to this privacy policy on our home page or as a minimum, on the first significant page after entering our website.
  • Our privacy policy link includes the word 'Privacy' and can easily be found on the page specified above.
  • You will be notified of any privacy policy changes through an adjustment made on our privacy policy page.

“Do Not Track” Signals Under CalOPPA

Our Site does not support “Do Not Track” browser settings and does not currently participate in any “Do Not Track” frameworks that would allow us to respond to signals or other mechanisms from you regarding the collection of your personal information.

CHANGES TO OUR PRIVACY POLICY

Applicable law and our practices change over time. If we decide to update our privacy policy, we will post the changes on our Services. If we materially change the way in which we process your personal data, we will provide you with prior notice, or where legally required, request your consent prior to implementing such changes.
